Can I keep chickens on my property?
The keeping of chickens is permitted in many of our residential districts with an approved zoning certificate. Some additional regulations to avoid conflicts with neighboring properties must be followed. Complete details can be found HERE.
Can I place a fence on my property line?
Fences are allowed to be placed up to the property line but cannot cross the property line.
How tall can I let my grass get??
For all land zoned other than “Rural District,” grass shall not be permitted to grow to a height exceeding eight (8) inches. Any growth of any such grass in excess of eight (8) inches is declared a nuisance.
Can I build a garage, and then a home?
No. Detached garages are accessory structures. The home must be built first. (Albany Village Code Section 155.751(D)
Do I need a permit to install a patio?
If the patio is constructed of poured-concrete or brick pavers at grade, you do not need a permit.
Do I need a permit to replace a shed?
Yes, replacing existing structures does require a new zoning permit.
Do I need a permit to have a business in my home?
Yes, a Conditional Use Permit is required. Refer to the standards for a Home Occupations in the Zoning Code. (Albany Village Code Section 155.762)
What do I need to start a new business in an existing commercial building?
You will need a Zoning Certificate from the Village of Albany.
Who does inspections for sidewalks and driveways?
The Village of Albany Village Adminiistrator inspects all sidewalks, driveways and roads. Contact them at (740) 698-6127
Does the Village enforce neighborhood covenants when they exist?
The Village of Albany has no legal ability to enforce private covenants. Deed restrictions or a neighborhood Homeowner’s Association rule are private covenants and restrictions that are of a Civil nature.
Are there any zoning-code regulations concerning animals?
Farm animals may only be kept on property located in a Rural (R-R) district.
What do I need to do to subdivide my land?
Any proposal to create a new, buildable lot must be approved as a subdivision by the Planning Commission. For application materials and requirements, contact the Albany Village Administrator at (740) 698-6127
