Utility and Underspeed Vehicles

CLARIFICATION ON SLOW MOVING VEHICLES ON VILLAGE STREETS

Residents please be advised that the only slow moving vehicles allowed on village streets are licensed side-by-sides (UTV-utility vehicle) or golf carts (USV-under-speed vehicle). Ohio Revised Code 4501.01 (VV) and (XX) defines these vehicles that are subject to the Albany legislation.

According to the Ohio Bureau of Motor Vehicles and State of Ohio, mini-bikes, mopeds, ATV’s, Gators, Go-Carts, anything that cannot be licensed through the BMV and insured can not be on village streets and you are subject to be ticketed. 

Ohio Revised Code Section 4511.215 allows a local government, such as Albany, to authorize, by ordinance, the operation of utility or under-speed vehicles on its streets. Albany has done that by adopting Village Code Section 73.16 authorizing the operation of certain Utility (side-by-side) and Under-speed (golf cart) vehicles on village streets subject to Ohio law.

Can anyone operate a properly registered UTV or USV on village streets?

No. The golf cart (USV) or side-by-side (UTV) can only be driven by a licensed driver who must be able to provide proof of insurance.  

Can my golf cart (USV) or side-by-side (UTV) be driven on US 50?

No. Ohio law provides that golf carts and side-by-side vehicles can only driven on roads with 35 mph or lower speed limits.

How can I get my UTV or USV inspected in Albany?

The Albany Police Department is certified to inspect your vehicle. Upon passing the inspection you will be given a signed Certificate of Inspection, and the officer will affix a safety sticker to the windshield of your vehicle.

What is the difference between a UTV and an ATV?

An ATV (All-Terrain Vehicle) and a UTV (Utility Task Vehicle), while both designed for off-road use, differ significantly in their structure, intended use, and features. ATVs are typically smaller, single-rider vehicles with handlebars, while UTVs are larger, side-by-side vehicles with a steering wheel and often more cargo capacity.
